Terms of Service

1. Agreement to Terms

By accessing or using the RealtyFlow marketplace (“Platform”), you agree to be bound by these Terms of Service and our Privacy Policy. If you do not agree, do not use the Platform.

RealtyFlow is operated by RealtyFlow Ltd., a company incorporated in Kenya. References to “RealtyFlow”, “we”, “us”, or “our” in these Terms refer to RealtyFlow Ltd.

2. Description of Service

RealtyFlow is an online real-estate marketplace that connects property seekers (“Buyers”) with licensed real-estate agencies and agents (“Listers”). We provide tools to search, save, and enquire about residential and commercial properties listed for sale, rent, or short stay.

We are a technology platform only. We do not own, list, or sell property and are not a party to any transaction between Buyers and Listers. All listing information is provided by Listers and we do not warrant its accuracy or completeness.

3. Accounts

• You must be at least 18 years old to create an account.
• You are responsible for maintaining the confidentiality of your login credentials.
• You must provide accurate and current registration information.
• One person may not maintain more than one active buyer account.
• You may delete your account at any time from your account settings. Upon deletion we will remove your personal data in accordance with our Privacy Policy.

4. Acceptable Use

You agree not to:

• Submit false, misleading, or fraudulent inquiries.
• Scrape, harvest, or systematically download listing data without our written consent.
• Use the Platform for any unlawful purpose or in violation of any Kenyan law or regulation.
• Interfere with the security or integrity of the Platform.
• Impersonate any person or entity, or misrepresent your affiliation with any person or entity.
• Use automated bots or scripts to interact with the Platform.

5. Property Listings & Inquiries

All listings are provided by Listers and are subject to availability. Prices, availability, and property details may change without notice. When you submit an inquiry, your contact details are forwarded to the Lister responsible for that property. RealtyFlow is not responsible for the Lister’s subsequent communications or actions.

By submitting an inquiry, you consent to being contacted by the relevant Lister regarding the property and give the Lister permission to store your contact information in their CRM system for the purpose of following up on your inquiry.

6. Intellectual Property

The RealtyFlow name, logo, and all platform content created by us (including design, text, and software) are our intellectual property and may not be copied, reproduced, or distributed without our express written consent. Listing content (photos, descriptions) remains the property of the respective Listers.

7. Privacy & Data Protection

Our collection and use of your personal information is governed by our Privacy Policy, which forms part of these Terms. We process personal data in accordance with the Kenya Data Protection Act 2019 (Cap. 411C) and its subsidiary regulations.

8. Cross-Border Data Transfers

To provide the Platform, we use third-party technology service providers whose servers and infrastructure are located outside of Kenya, including in the United States and the European Union. By using the Platform, you acknowledge and agree that your personal data may be transferred to, stored in, and processed in countries outside Kenya.

Such transfers are carried out under appropriate contractual and technical safeguards in compliance with Section 48 of the Kenya Data Protection Act 2019. The categories of data that may be processed internationally include account information, usage data, and inquiry content.

We enter into data processing agreements with all third-party processors to ensure your data receives an adequate level of protection. For a current list of our sub-processors or to raise a concern about an international transfer, contact us at legal@realtyflow.co.ke.

9. Third-Party Links & Services

The Platform may contain links to third-party websites or use embedded third-party tools (e.g. map services). We are not responsible for the privacy practices or content of those third-party services. Your use of such services is governed by their own terms and privacy policies.

10. Disclaimers & Limitation of Liability

The Platform is provided “as is” without warranties of any kind, express or implied. We do not warrant that the Platform will be uninterrupted, error-free, or that listing information is accurate. To the maximum extent permitted by Kenyan law, RealtyFlow shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the Platform, including losses arising from reliance on any property listing or from transactions between Buyers and Listers.

Our total liability in connection with these Terms shall not exceed KES 10,000 or the amount you paid us in the preceding 12 months, whichever is greater.

11. Indemnification

You agree to indemnify and hold RealtyFlow and its directors, officers, and employees harmless from any claim, liability, or expense (including reasonable legal fees) arising from your use of the Platform, your violation of these Terms, or your violation of any third-party rights.

12. Termination

We may suspend or terminate your account immediately if you violate these Terms, engage in fraudulent activity, or if we are required to do so by law. Upon termination, your right to use the Platform ceases immediately. Provisions that by their nature should survive termination (including Sections 6, 10, 11, and 13) shall do so.

13. Governing Law & Disputes

These Terms are governed by and construed in accordance with the laws of Kenya. Any dispute arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Kenya. Before commencing legal proceedings, parties agree to attempt to resolve disputes in good faith by written notice with a 30-day resolution period.

14. Changes to These Terms

We may update these Terms from time to time. We will notify registered users by email at least 14 days before material changes take effect. Continued use of the Platform after changes take effect constitutes your acceptance of the updated Terms. If you do not agree to the updated Terms, you must stop using the Platform and may delete your account.
